#LOVEMYHOOD SS15 Twitter/Instagram Picture Competition (the “Competition”)

ENTRY TERMS AND CONDITIONS

  1. Acceptance of Terms and Conditions:
    • This Competition is organised and run by Americana International Limited (hereinafter “Bench”), Tanzaro House, Ardwick Green North, Manchester, M12 6FZ, UK.
    • Entry into the Competition is deemed acceptance of these T&Cs.
    • Bench reserves the right to cancel or amend competition details (including but not limited to the prizes or end date of the competition) or the terms and conditions relating to competitions (including the eligibility requirements) at its sole discretion with or without prior notice (i) in the event of any occurrence outside Bench's reasonable control (ii) to ensure the competitions are run in a fair and honourable manner, and (iii) to ensure compliance with applicable laws, regulations and guidance.
    • Any cancellation or changes will be posted onto Bench’s Twitter, Facebook and Instagram pages as well as detailed on the relevant Competition page at www.lovemyhood.me.
    • This promotion is in no way sponsored, endorsed or administered by, or associated with Twitter, Instagram or any other social media. You understand that you are providing your information to Bench and not to Twitter or Instagram. Participation in this Competition assumes acceptance of the Instagram and Twitter terms and conditions, available at: http://instagram.com/legal/terms/ https://twitter.com/tos.
  2. Entry requirements:
    • The Competition starts on 17th March 2015.
    • In order for their entry to be valid under clause 4 below, entrants must satisfy the “Eligibility” requirements at clause 3 below.
    • All entrants must have an Instagram account, with privacy setting set to ‘public’ or a public Twitter account.
    • All entries must always use the hashtag #LOVEMYHOOD.
    • Only entries submitted via Instagram or Twitter and which are appropriately captioned (i.e. using #LOVEMYHOOD) will be accepted.
    • This Competition is open to individual entries only, no group entries will be considered valid.
    • There is no maximum number of entries per entrant.
    • Entrants must be available and willing to travel to Spain for the festival in the event that they are named the Competition winner. The relevant dates for travel are 13th - 20th July 2015.
  3. Eligibility:
    • Entry to the competition is only open to persons who are:
      • at least 18 years old (21 if a US citizen); and
      • not employees of, or family of employees of, or in any way professionally connected to, Americana International Limited.
    • By entering this competition you hereby warrant that all information submitted by you is true, current and complete. Bench reserves the right to verify the eligibility of all entrants and disqualify an entrant for submitting false information.
  4. Entries:
    • Entries will be judged according to creativity and originality and must be validly submitted prior to the Competition end date on May 31st 2015.
    • Each entry must be original work by you and you must have obtained the permission from all persons appearing in Images and relevant property owners to enter this Competition. You warrant that your entry is not, and its use by Bench will not, infringe the rights (including intellectual property rights) of any third party.
    • You must enter with a picture that you have the rights to use, and in doing so you grant Bench a worldwide, non-exclusive, perpetual and royalty-free licence to use, reproduce, process, adapt, modify, publish, broadcast, transmit, display or distribute your entry (in whole or in part) in any and all media, publications or distribution methods (now known or later developed) for any purpose Bench may deem appropriate including, but not limited to, marketing and advertising purposes such as through digital feeds via Bench’s websites, Facebook pages, Twitter accounts and Instagram accounts, in subsequent Competition promotions (with attribution), or printed for physical events by Bench. You will not be entitled to any fee for such use.
    • Bench may, in its absolute discretion, disqualify:
      • any entry which is not original, does not comply with the Instagram or Twitter Terms of Use (hyperlink at clause 1 above), is not completed in accordance with these Terms, infringes the intellectual property rights of any third party, contains any objectionable, offensive or poor quality content, or has the potential to damage the reputation of any person or corporation; or
      • any individual who tampers with the entry process, submits an entry that is not in accordance with the Terms, or who has in the opinion of Bench, engaged in unlawful or improper conduct that is designed to, or is likely to, adversely affect the fair and proper conduct of the Competition or is generally damaging to the goodwill or reputation of Bench.
  5. Identifying a winner:
    • The winner will be selected from the valid entries by 8th June 2015. The winner will then be announced by Bench through its official social media channels on or after this date.
    • The winner will be chosen by a panel of 3 independent judges; Mark Janson (COO, RetroFuzz), Chloe Longstaff (Canoe PR Owner), Percy Dean (Photographer), who will make final judgement based upon their own preferences.
    • The decision of Bench in relation to the conduct of the Competition, including the selection of winning entries, is binding and conclusive and no correspondence will be entered into.
  6. Prizes and how to claim:
    • The Prize is:
    • a years’ worth of Bench hoodies (12 hoodies – total value of up to £1200);
    • Flights and VIP tickets to Festival Internacional de Benicàssim for two people on 13th - 20th July 2015.
    • Bench shall endeavour to contact the winner via their Instagram account within one week of the prize draw (8 June 2015). In the event that a winner fails to respond and contact Bench within two weeks of being contacted by Bench, an alternate winner will be selected on the basis of these Terms and Conditions and the original winner will forfeit any prize.
    • Prizes are non-transferable, non-exchangeable and have a cash value of zero. Bench reserves the right to substitute prizes of equal or similar value at any time in its sole discretion.
    • Prizes are valid until the expiry date specified by Bench and the vendors involved, and subject to the conditions stipulated by vendors involved.
    • Bench does not take any responsibility if a winner is unable to travel to a particular city for reasons out of Bench’s control.
    • If any part of the prize is postponed, sold out, cancelled or varied for any reason, then at Bench’s discretion, the winner forfeits all rights to participate in the relevant event and no cash or alternative prize will be substituted for that element of the prize.
    • Any expense outside of those specified in the prize details, will be the prize winner’s sole responsibility.
    • No responsibility will be taken by Bench for any change in dates, times or cancellations or other arrangements that may prevent a winner from accepting, taking or using a prize. Bench accepts no responsibility for late, lost, incorrectly submitted or misdirected entries, for any technological malfunction or failure, Internet traffic congestion, or for outdated or incorrect contact details by which you cannot be contacted during business hours on relevant dates.
  7. No warranties: Bench makes no warranties or representations about the fitness for purpose or suitability of any prize and will not accept responsibility for the quality or fitness for any purpose of any prize, or the failure of any prize to be of merchantable quality. If liability under terms implied by legislation cannot be excluded by Bench, the liability of the Bench is limited to re-supplying the tickets or awarding a prize of equivalent value.
  8. Your personal information:
    • You consent to the disclosure of your personal information (including the Image(s), an identifiable image of yourself if this forms part of your entry, Instagram account name or Twitter handle and full name) to Bench for the purpose of this Competition, including associated promotional purposes.
    • By entering this Competition, you give Bench permission to add you to their email database, and you will receive promotional emails with offers, news and information. You can unsubscribe at any time.
    • Bench may use your personal information in accordance with the privacy policy available on our website.
    • The winner may be required to partake in reasonable publicity in connection with this competition including the publication of their names and geographical location by Bench.
  9. Varying the Competition:
    • In the event that Bench cancels or varies the Competition/Prizes in accordance with clause 1 above, it is not:
      • liable to any person for any costs, loss or damage whatsoever arising out of, or in connection with, such cancellation, variation or withdrawal; or
      • required to conduct the Competition at any other time.
  10. You enter the Competition at your own risk:
    • With the exception of liability which cannot be excluded by law, Bench is not liable for, and you release Bench from, liabilities relating to any direct or indirect loss or damage which is suffered, or for personal injury or sickness suffered or sustained, as a result of entering the Competition, failing to win, winning, accepting or using a prize.
